Attorney Knicole Emanuel has another blog post (yes, I am a big fan of her blog) about Medicare audits. She describes “compliance” as a “Kafkaesque masterpiece of government regulation.” The reference is to an allegorical short story, “Before the Law,” by Czech writer Franz Kafka. She makes the point that auditors (financially incentivized to find fault with your documentation and interpret Medicare guidance) can detect microscopic discrepancies and interpret them as fraud. The post is not about “skin substitutes/CTPs/CAMPS” but is relevant to them.
With or without the implementation of the LCD(s), audits on the use of these products are pervasive and detailed, as recent guest blogs by Martha Kelso and Michael Crouch have discussed. Every practitioner using these products is going to deal with one or more Medicare auditors.
